Alquiler provides a cloud-based Software as a Service (SaaS) solution for booking management, calendars, and property management, intended for hotels, vacation rentals, and hospitality professionals worldwide.

3. Acceptance of Terms

By accessing or using the Service, the user acknowledges having read, understood, and agreed to be bound by these Terms & Conditions. If the user does not agree with these terms, they must refrain from using the Service.

4. Eligibility

The Service is intended exclusively for professional and business users (B2B). By using the Service, the user confirms that they are acting in a professional or commercial capacity.

5. Account Registration

Users must provide accurate, complete, and up-to-date information when creating an account. Login credentials are strictly personal and confidential. The user is solely responsible for all activities carried out under their account.

6. Subscriptions & Fees

• Access to the Service is provided through paid subscriptions or a free trial, if available

• Prices are displayed excluding applicable taxes, unless explicitly stated otherwise

• Subscriptions may be billed on a monthly or annual basis

• Payments are processed securely via authorized third-party payment providers

Failure to pay applicable fees may result in suspension or termination of access to the Service.

7. Free Trial

If a free trial is offered, it is limited in duration and functionality. ALQUILER PROPERTY SL. reserves the right to modify, restrict, or discontinue the free trial at any time without prior notice.

8. User Obligations

Users agree to:

• Use the Service in compliance with all applicable laws and regulations

• Not misuse, copy, resell, sublicense, or reverse-engineer the software

• Ensure the legality, accuracy, and integrity of all data entered into the platform

• Refrain from using the Service for unlawful, fraudulent, or abusive purposes

9. Availability & Maintenance

ALQUILER PROPERTY SL. strives to ensure reliable access to the Service but does not guarantee uninterrupted availability. Temporary interruptions may occur due to maintenance, updates, technical issues, or events beyond reasonable control (force majeure).

10. Intellectual Property

All intellectual property rights relating to the Service, including but not limited to software, trademarks, designs, content, and documentation, remain the exclusive property of ALQUILER PROPERTY SL. No ownership or intellectual property rights are transferred to the user.

11. Data Protection

Personal data is processed in accordance with the Privacy Policy and applicable data protection laws, including the GDPR.

The user acts as data controller for guest and customer data entered into the platform, while ALQUILER PROPERTY SL. acts as data processor.

12. Limitation of Liability

ALQUILER PROPERTY SL. shall not be liable for:

• Any indirect, incidental, or consequential damages

• Loss of profits, data, revenue, or business opportunities

• Issues arising from third-party services, integrations, or external providers

In all cases, the total liability of ALQUILER PROPERTY SL. shall be limited to the total amount paid by the user during the twelve (12) months preceding the claim.

13. Termination

Either party may terminate the subscription in accordance with the conditions of the selected plan.
ALQUILER PROPERTY SL. reserves the right to suspend or terminate access immediately in the event of a serious or repeated breach of these Terms & Conditions.

14. Modifications

ALQUILER PROPERTY SL. may update or modify these Terms & Conditions at any time. Continued use of the Service after publication of changes constitutes acceptance of the revised terms.

15. Governing Law & Jurisdiction

These Terms & Conditions are governed by Spanish law. Any dispute arising from the interpretation or execution of these Terms shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain
